The Short Answer: No, But There's a Catch

According to Dubai’s land laws, there is no legal obligation to hire a real estate agent to rent out your property. As a landlord, you are free to find a tenant and manage the process yourself, provided your ownership is officially registered with the Dubai Land Department (DLD).

However, if you do choose to use an intermediary, they must be a licensed broker registered with the Real Estate Regulatory Agency (RERA). This ensures they operate under Bylaw No. (85) of 2006, protecting both you and the tenant.

The DIY Landlord: What Are Your Legal Responsibilities?

Choosing to rent out your property without an agent means you must personally handle the legal compliance. According to Law No. (26) of 2007 and Law No. (33) of 2008, here is what you are responsible for:

1. The Contract and Ejari

You must draft a written lease contract that leaves "no room for uncertainty." This document must detail the rent, payment method, lease term, and property details. Crucially, Article 4 states that all lease contracts must be registered with RERA (the Ejari system) to be legally valid.

2. Handover Condition (Article 15)

You are legally bound to hand over the property in "good condition" that allows the tenant full use. You cannot hand over a unit with major defects or pending repairs.

3. Maintenance and Repairs (Article 16)

Unless you explicitly agree otherwise in the contract, the landlord is responsible for all maintenance works and repairs that affect the tenant's use of the property during the lease term. This is a common point of dispute that a professional property manager usually handles.

4. Liability for Defects (Article 17)

You are responsible for any defect, damage, or wear and tear that is not the tenant's fault. Furthermore, you cannot make changes to the property (or its amenities) that would prevent the tenant from using it fully.
